Main judgment, judgment
Issue of visit to Yasukuni Shrine
In the court where 211 people who were resident in Kyushu pursued compensation for damages in, I dismissed the request of the plaintiff in Fukuoka District Court judgment on April 13, 2004 saying that freedom of religion was violated by having gone and worshiped in Prime Minister Koizumi Yasukuni shrine on August 13, 2001. However, I recognized it being to when worship of Prime Minister Koizumi was public by a paraidea, and it was said, "the worship is unconstitutional" [2]. In a judgment reason, I bring that worship is repeated while a discussion of the constitutionality of the worship is not accomplished enough into question. If a court avoided a judgment about unconstitutionality of the worship, did it when a similar act was repeated in future, and stated, "think about judging unconstitutionality with own duty" [3]; [4]. It was the second case next to Sendai High Court judgment of 1991 to have judged the visit to Yasukuni Shrine by the Prime Minister to be unconstitutional (it refers to Iwate assembly Yasukuni shrine suit).
For this judgment, the people's social campaign group "meeting in response to soul" required the dismissal of the judge of three Kamegawa and others and performed exercise such as submitting a prosecution request form to the Judges Indictment Committee of the Diet.
Person
In the case of the Naha District Court director assumption of office, I stated, "the judge may participate as a private citizen with the knowledge of the law" about lay judge system [5].
