Illegally parked stranding foreign ship

The illegally parked stranding foreign ship (ほうちざしょうがいこくせん) is the foreign ship which was left with running aground on the coast and is the ship which possibility of the processing does not stand by removal refusal or disappearance on the shipowner side. The ship which it is done a sea out-of-store sales ship and becomes the foreign family register ship, and departed from Japan runs aground and is often left unattended. Belize registry dredger "Toyosaka" done 売船 runs aground in Oriuzako, Miyazaki-shi on December 23, 2010 and, after revised ship oil pollution compensation for damages security law, is left unattended [1]. As of 2005, ten illegally parked stranding foreign ships are confirmed in Japan.

The cause that is left

I will need a large amount of expense for the removal of the ship which ran aground, but removal becomes often impossible without being able to manage to come up with an expense by the financial difficulty of the shipowner, P&I (PI insurance) non-participation [3]. The substandard ship has high ratio that is PI insurance non-participation. Participation of the PI insurance was necessary to enter Japan after ship oil pollution compensation for damages security law was applied. The arrival in port to the Japanese port was thought to be impossible, but I joined PI insurance considered to have a problem with quality, and the substandard ship came to enter Japan. There is the problem that is not proved until a ship runs aground whether quality has a problem. It is the example which cargo boat "JANE" of the Saint Vincent and the Grenadines family register that ran aground off Yamamoto-cho, Miyagi on April 17, 2007 has good. The second Regional Coast Guard Headquarters applied revised Sea Pollution Prevention Act for the first time in the whole country, but was not removed immediately.

A ship is registered with the sea out-of-store sales ship nominal registry country which I can register even if inspection simply or hardly inspects it to control an expense with the case of many cause coastal vessels which it is done, and depart from Japan as a foreign registry ship. The problem nominal registry country neglects monitoring, the supervision that a ship registered at home obeys an international treaty and does not take responsibility [4]. Because inspection of the port state control (PSC: a foreign ship controller) is easy and does not come for inspection, there is the case which I can depart from in the state of the substandard ship though I have a problem. Because the probability that is the substandard ship that is in a state with the problem is very high, I wake up a sea disaster (stranding) after the departure from a port. There was the example which did not take out PI insurance in one of the cost cuts. As a result, all foreign registry ship ignored before revised ship oil pollution compensation for damages security law was PI insurance non-participation [5].

Problems

A solution or precaution

Port state control (PSC: a foreign ship controller) inspects it for the ship with the problem strictly and starts an embargo order if I have a problem. Port state control (PSC: a foreign ship controller) performs a severe check about the ISM cord and improves education and the quality of the sailor. A problem substandard ship becomes unable to easily enter the Japanese port again (because there is the case which does not have a defect pointed out by foreign ship controller) port state control (PSC even if the present conditions are substandard ships, it is not solved the problem).

It is necessary to improve it because there is a defect for an issue of security contract certificate process required by revised ship oil pollution compensation for damages security law [7]; [8].

I cope [9], and Ministry of Land, Infrastructure and Transport does not seem to think about illegally parked stranding ship measures that the control of the substandard ship is connected for illegally parked stranding ship measures. It is done out-of-store sales, and, as for most of illegally parked stranding ships which Ministry of Land, Infrastructure and Transport shows, a Japan-registered coastal vessel receives the export permission of the customs and runs aground just after the departure from a port in Japanese territorial waters from Japan [10].
